Sobre o Procurador-Geral


I am an Australian who worked as a Judicial System monitorer in East Timor.

I greatly fear for the future of justice in East Timor. I read with great trepidation that an investigation to establish the guilt or innocence of a high and controversial political figure such as the former Prime Minister is in the hands of a Prosecutor General who during my time working in East Timor had both he and his office under a cloud of question and suspicion for allegations of unethical and corrupt practices, that were never properly and fully investigated.

The cloud hanging over the prosecutor general's office is susbtantive as it remains unresolved.

Never at any stage did he or any of his colleagues seek to have their names or office cleared by referring the matter to or seeking an independent inquiry to investigate.

They simply hid behind the veil that there was not yet at the time any existing legislative mechanism for oversight and or investigation of the Porsecutor General's office. Further, he could have referred the matter voluntarily to the Provedor of Justice and Human Rights when he was appointed just to show that transparency is not just waiting to be done but seen to be done. This too was not done.

The allegations against the Prosecutor General, an assistant prosecutor and another lawyer were very public and serious. Such matters should have been investiagted to establish their innocence, which I presume to be their status until proven guilty.

Instead, the accusers were threatened with defamation action, which from memory was commenced but is yet to be finalised, and could have resulted and may still result in prison sentences for defamation for some human rights lawyers advocating the case against the Prosecutor general and his colleagues.

During my three years or so there, there were many other cases of loss of evidence and fabrication of evidence and falsification of documents.

I do not have faith in such a person with such suspicion having the carriage of a prosecution investigation against an ordinary citizen in East Timor and certainly not such a person as the former PM of East Timor, particularly given the political questions which have arisen in the porcess.

This is nothing to say of the question we all had at the time of the legality of the continued tenure of the Prosecutor General and other prosecutors, who were appointed by the deceased SRSG Sergio De Mello, and which has according to the learned opinion of many already expired and is now dependent on the reappointment by the President of the Republic.

Not much needs to be said about this in the circumstances as I think most readers will be aware of the President's publicly stated views on the pre-established guilt of the former Prime Minister on matters being delved into by a Prosecutor General with such clouds hanging over him.

Without doubt such facts about the Prosecutor would be known to the President, because East Timor is a small place.

Justice must be seen to be done and not just be done......East Timor has suffered enough of the lack of this need...thanks to many....let it not be the case again....as justice would never again be done in East Timor.

E engracado que este "Australiano/a" so esta preocupado com a figura do Alkatiri e nem faz referencia entao a possivel injustica que pode ser feita a Rogerio Lobato. Pobre Rogerio ja foi esquecido por todos ou por ser dispensavel ou por ser ja contraproducente associar o seu nome a de Alkatiri por ser tao evidente a sua accao criminal nesta questao.
Mas sera que ainda nao perceberam que a responsabilidade de Rogerio esta intimamente ligada a responsabilidade de Alkatiri quanto ao esquadrao de morte?
Timor e tao pequeno assim como a PGR que e facil saber quem e esta timorense com a capa de australiana.

I think there is an independent international investigating comission which will investigate all the causes of the turmoil in Dili and the allegations against Rogerio Lobato and Mari. Correct if I am wrong.

Temo bastante pelo futuro da justiça em Timor-Leste. Li com grande nervosismo que uma investigação para apurar a culpa ou a inocência duma figura política altamente controversa como é o antigo Primeiro-Ministro está nas mãos dum Procurador-Geral que no tempo em que trabalhei em Timor-Leste estava, ele e o seu Gabinete envolto numa nuvem de questões e suspeitas por alegações de praticas não éticas e corruptas, que nunca foram devida e completamente investigadas.

A nuvem que paira em cima do Gabinete do Procurador-Geral é substantiva e mantém-se sem resolução.

Em ocasião alguma ele ou os seus colegas procuraram que os seus nomes ou o nome do Gabinete fossem limpos, referindo-se ao assunto ou tentando que um inquérito independente investigasse.

Esconderam-se simplesmente atrás do biombo de que não havia ainda na altura um mecanismo legislativo para superintender ou investigar o Gabinete do Procurador-Geral. Mais, ele podia ter remetido a questão voluntariamente para o Provedor da Justiça e dos Direitos Humanos quando foi nomeado para mostrar que a transparência não se espera somente que seja feita mas vista que é feita. Também isto não foi feito.

As alegações contra o Procurador-Geral, um Procurador adjunto e um outro advogado eram públicas e muito graves. Tais assuntos deviam ter sido investigados para estabelecer a sua inocência, que presumo ser o estatuto deles até se provar culpado.

Em vez disso, os acusadores foram ameaçados com acção por difamação, que me lembre foi começada mas ainda não finalizada, e podia ter resultado e pode ainda resultar em sentenças de prisão por difamação para alguns advogados de direitos humanos advocando o caso contra o Procurador-Geral e os seus colegas.

Durante os meus três anos, ou à volta disso, lá, houve muitos outros casos de falta de evidência e fabricação de evidência e falsificação de documentos.

Não tenho fé em tal pessoa com tal suspeita ter estofo para uma investigação contra um cidadão ordinário de Timor-Leste e muito menos contra o antigo PM de Timor-Leste, especialmente dadas as questões políticas levantadas no processo.

Já para não falar que na altura todos nós levantámos a questão da legalidade da continuidade no cargo do Procurador-Geral e outros procuradores, que foram nomeados pelo falecido SRSG Sergio De Mello, e de acordo com a opinião de muitos já expirou e depende agora da renomeação do Presidente da República.

Nem é preciso dizer muito mais acerca disto e das circunstâncias que penso a maioria dos leitores conhecem do Presidente ter publicamente declarado a sua ideia da culpa pre-estabelecida do antigo Primeiro-Ministro em matérias tratadas por um Procurador-Geral com tais nuvens a pairar por cima dele.

Sem dúvida que tais factos acerca do Procurador são do conhecimento do Presidente, porque Timor-Leste é um lugar pequeno.

A justiça deve ser vista para ser feita e não somente ser feita...... Timor-Leste sofreu bastante da falta desta necessidade...graças a muitos....não permitemos que seja o caso mais uma vez....porque a justiça nunca mais se faria outra vez em Timor-Leste.
